TEH JOURNAL~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~

If you STILL haven't seen this or heard it, then be prepared to want to kill whomever tried to implement, write or even think about the "Orphan Works Law" thang that has every possible artist who have heard about this actually wanting to put a hole through this person's head.

[link] - long interview but worth it.

[link] - long-ass read but well worth it.

Plase, do yourself a favor, read it and pass it on. I mean, hell, it's even worse than the Squenix contest... DX

It's okay, it's not as bad as it seems. Here's something I saw in art_theft on lj:

""OK, I'm starting to feel this is a little blown up. If this: [link] is the legislation they are talking about, it doesn't say all artists lose their right to their work and have to pay money to register every doodle on a napkin they do so it doesn't get stolen. It says for the most part that if someone makes a reasonably documented search for something and is unable to find the copyright owner then they are allowed to use it, and if the copyright holder is found then they can get damages for the infringement.

The long and short of it is: the bill isn't so people can screw us off and make monies. This is to benefit things like old recordings and historical documents that can't be released to public domain due to copyright, despite the owner being long gone. Anyone who uses this to weasel out of paying someone will be slapped down.

Ie, it's not black and white.""

Well that is what the legislation intends to do but, as you said, these weasels, will say they "searched for the original creator of the work and found nothing". One problem I see is that they used the phrase "diligent search", which is way too general (I can say looked for someone to use someone's image and didn't found it's original painter because it wasn't written anywhere in the work itself and looking for it in the internet would be pointless because of the huge amount of info that is currently on the net. The name might've been there but, unbeknownst to everyone, I photoshopped it off).

Besides, why would they want to use something old when they could just pay someone else to do something better... Seems like a way for them not have to waste any money on resources to me... Which sucks skunk-ass.
